I. TEACHING AND MANAGEMENT BENEFIT

The enrollment to framed services of VALRAFTING implies the pure and simple acceptance of these general conditions by the subscriber, who undertakes to inform each participant of all the terms and conditions.

ART. 1 – SPEAKERS

VALRAFTING offers for its account, the account of authorized companies and the account of independent instructors, the supervision and the teaching of sports disciplines said to risk and of full nature: climbing, speleology, via ferrata and via corda, canyoning, rafting , whitewater swimming, kayak and inflatable kayak and canoe-raft. All activities offered are supervised and provided by qualified guides in their respective disciplines and meeting their legal obligations.

ART. 2 – REGISTRATION AND RESERVATION

All our activities are on reservation. For this, you have several solutions: by completing the online application form or by contacting VALRAFTING directly via email via the online contact form, by phone at +41 79 385 89 47 or by booking online.

The balance of the reservation will be paid directly to VALRAFTING at the beginning of the activity.

ART. 3 – PRICE

VALRAFTING’s rates are presented on the website and on the catalog of activities available at the reception.

The prices include: the organization, the provision of supervision by a qualified guide and the loan of technical equipment and safety necessary for the practice of the chosen activity (wetsuit and neoprene jacket, neoprene booties, helmet, harness , lifejacket, etc.).

The possibility of renting equipment is possible on special request by mail or telephone.

In any case, we invite you to refer to the product data sheet, available on our website or on request.

Activity prices do not include: transportation to the venue or personal expenses.

For day trips, meals (picnic, water, snack) are the responsibility of the customer, unless otherwise stated.

ART. 4 – PAYMENT METHOD

For coaching services, payment must be made directly to the instructor who ensures the session for the attention of VALRAFTING. In the case of subcontracting with a company or independent payment or remaining payment will be made directly on site to the provider who carries out the activity.

Means of payment accepted: Bank transfer, credit card (secure payment by internet or on site with TPE) or cash.

ART. 5 – CONDITIONS OF PARTICIPATION

Our activities are open to everyone; however, depending on the activities and routes, certain conditions must be taken into account (age limit, swimming ability, technical level, physical condition, etc.).

VALRAFTING does not have the means to check the level of sporting practice of its customers.

It is therefore up to each participant to have assessed his fitness according to the course choices he wishes to achieve. For these conditions, please refer to the technical information of the courses (available on our website www.valrafting.com).

In addition, it is necessary to read, sign to accept the conditions of participation and submit the participation form before the start of the activity.

For canyons and whitewater activities, you must know how to swim 25m and immerse yourself.

You must not be subject to a medical contraindication to the practice of the chosen activity.

IMPORTANT: You are not subject to a medical contraindication but you are dependent on medical care or special medical treatments (asthma, diabetes, etc.) or your state of health requires special attention (fragile articulation, problem back, wearing glasses mandatory, etc.), you must inform the monitor before the departure of the activity and provide the appropriate emergency medicine, according to medical recommendations.

ART. 6 – INSURANCE AND LIABILITY

Each instructor / professional is insured in Professional Civil Liability for activities within VALRAFTING or for its own activities (subcontracting) as well as for the costs incurred by a possible rescue operation.

We strongly advise each participant to be covered by a civil liability insurance and / or an individual accident with the insurance of his choice for the practice of water sports and / or mountain. Indeed we can not replace the individual civil liability of each participant.

VALRAFTING is insured in civil liability for all the activities it offers and its liability can not be incurred for activities booked or carried out with other providers.

In the event of a personal injury, the responsibility of VALRAFTING and the attending instructor is released as soon as the victim is taken care of by the competent rescue organizations, and any hospital following will be the responsibility of the injured person’s personal insurance.

The practice of outdoor activities takes place in a specific environment called “at risk”.

Each participant is aware, given the specific nature of the proposed activities, that he may run some risks due in particular to the remoteness, isolation and specific character of the environment (river, cave, cliff, etc.). He assumes them with full knowledge of the facts and he must comply with the rules of prudence and follow the advice given by the professionals.

The participant / client is responsible for the material that has been loaned for the activity. The professional can not be held responsible for damages that may be caused by the equipment made available.

In the event of theft or damage to the loaned material, the participant / customer may be asked for compensation for wear or for a total refund of the equipment.

Professionals (monitors) and VALRAFTING can not be held responsible for the loss, theft (including in vehicles) or the breakage of objects (eg glasses, cameras …) that practitioners could take with them during the visit. activity and can provide during the activity.

ART. 7 – CANCELLATION / INTERRUPTION BY CUSTOMER

7.1 Cancellation by the customer

– Cancellation of a booking more than 30 days at least: full refund of the deposit

– Cancellation of a booking more or less 15 days: the deposit is kept

– Cancellation of a reservation within 3 days: the balance will be required

In case of force majeure and under presentation of a proof, VALRAFTING can refund the amount paid, but can not be demanded by the customer. In any case, the customer agrees to notify VALRAFTING of all notifications relating to the reservation: organization of the program, change of staff, delay or cancellation.

For online reservations, the refund is only possible in the event of cancellation by VALRAFTING.

7.2 – Interruption during the performance

In case of interruption during the service, the customer or participant will not be able to claim any refund. A credit for a future service will be found between VALRAFTING and the participant / client.

ART. 8 – CANCELLATION / EXCLUSION OF VALRAFTING

8.1 – Cancellation

The VALRAFTING instructors reserve the right to cancel or adapt the output according to the weather conditions or the level of the participants.

The activity can be canceled for safety reasons (meteorology, dam water releases, floods …) or for any other case of force majeure. In this case, a replacement activity will be organized as much as possible or another date will be proposed. If the output can not be achieved, the benefit is fully reimbursed without being entitled to any other compensation.

In the case of a cancellation by us due to a number of insufficient participants (- of 3 people), the registrants will be fully refunded and will not be able to claim any compensation.

8.2 – Exclusion

The monitors of VALRAFTING reserve the right to exclude a participant who is intoxicated or whose behavior is such as to disturb the smooth running of the activity or compromise the safety of the group. In this case, the customer or participant can not claim any refund or compensation.

 

ART. 9 – APPOINTMENT

An hour and a place of rendezvous are systematically communicated to you whatever the service. For the good progress of the activities and out of respect towards the other participants and the professional who surrounds you, we ask you to take note of the roadmaps and other indications previously transmitted by us. Be sure to anticipate your journeys in order to be punctual and fill in the forms requested before your arrival. We tolerate a delay of up to 15 minutes. Beyond this period, the instructors leave in activities and no refund or compensation will be payable.

ART. 10 – SUPERVISION OF YOUNG PEOPLE (MINORS):

Unaccompanied minors:

Minors under 14 years old who are not accompanied by an adult (legal guardian) are not accepted in the activities.

Minors from 14 to 18 years unaccompanied, can be accepted in the activities, subject to parental authorization and under certain conditions (sporting level, skill, ..)

In this case parental authorization will be signed by the legal representative on the day of the activity.

Minors in the frame CVL / CLSH / School:

The organization organizing the stay or the exit will have to be able to provide the monitor and VALRAFTING, for each participant (young and animator)

– the form attesting to the ability to swim 25m and to immerse, provided by VALRAFTING for each participant.

On the other hand, VALRAFTING undertakes to provide, upon request, the certificates and documents necessary for the organization of the stay / departure (insurance, diplomas of supervisors, etc.)

The supervision of young minors with VALRAFTING which limits it to 14 young people and 2 animators (maximum) by raft and 7 young people plus 1 animators in canyon and hydrospeed. Each group of minors must be accompanied by 2 minmum adults including an animator of the center and the monitor supervising the activity.

ART 11. GOOD GIFT

The gift voucher is effective upon receipt of the full amount of the benefit.

The purchase order is nominative. However, it may be transferable to the person of your choice provided that you inform us in advance to change the details of the new beneficiary.

The recipient of the gift voucher must contact us to reserve the exit.

The gift voucher activity is replaceable by another activity proposed by VALRAFTING, provided that the value of the latter is less than or equal to the activity mentioned on the voucher. However it is possible to perform an activity of a higher amount by paying the difference.

ATTENTION: The gift voucher has an expiry date. After the validity period (current year), the service will be considered as executed and can not be postponed. The beneficiary and / or the buyer, can not claim any refund or compensation.

The gift voucher and the nominative document are to be presented the day of the exit to the monitor in charge of the session.

The output will be guaranteed in the case where the minimum number of participants required is assured and in the case where climatic conditions allow the good practice of the activity.

ART. 12 – SETTLEMENT OF DISPUTES

The parties will endeavor to resolve amicably possible difficulties that may arise in the performance of the contract. If no amicable agreement could be reached, all disputes relating to the validity, interpretation and execution of this agreement will be governed exclusively by the rules of Swiss law.

All disputes, whatever their nature, will fall within the jurisdiction of the Swiss civil and commercial courts. The legal jurisdiction is in Sion.

II. EQUIPMENT RENTAL

ART 1. BOOKING

All our activities including equipment rental are by reservation. For this, you have several solutions: by filling in the request form for an offer or contact online or by contacting VALRAFTING directly by mail (info@valrafting.com), by phone (+41 79 385 89 47) or again by booking directly online.

The reservation is effective from the moment the subscriber receives a message by email or SMS confirmation of reservation.

ART. 2 – PRICE

The rental rates are posted on the website in the C G V VALRAFTING.

Prices include: rental of technical equipment.

Below the different rental formulas:

Rental kit raft: paddle to the number of places of the raft, raft, pump. 250.-chf / day or 150.-chf / half day.

Kit equipment rental white water: wetsuit, jacket and slippers in neoprene, vest, helmet. 50.-chf / day or 35.-chf / half day.

ART. 3 – PAYMENT METHOD

The payment must be addressed to the order of VALRAFTING.

Means of payment accepted: bank transfer, by credit card (TPE) or cash.

A deposit of 200.-chf in cash is required for each equipment rented and will be returned when the equipment is returned. The balance will be paid upon delivery of the equipment.

The opening hours are mentioned during the delivery of equipment, in case of late return (outside opening hours) a surcharge of 20.-chf will be required and due.

ART 4. INSURANCE AND LIABILITY

In the case of a sports practice with equipment, and especially in the case of rental of sports equipment (excluding activities supervised by an instructor) the client acknowledges having the knowledge and technical skills sufficient to practice this sporting activity alone. The customer practices in this case under full responsibility and at his own risk the activity for which said equipment is rented. VALRAFTING can not be held responsible in case of accident that may occur during the said non-supervised activity.

Since the team and VALRAFTING do not have the means to verify the level of sports practice of their clients, it is therefore up to each participant / client to have assessed his fitness, knowledge and skills according to what he wish to achieve.

ART. 5 – INSURANCE

VALRAFTING is insured in Professional Liability for its own activities and can not be held liable for any incident or accident that may occur during a non-supervised activity.

In addition, we strongly advise each participant to be covered by a civil liability insurance and / or an individual accident with the insurance of his choice for the practice of mountain sports.

The practice of outdoor activities takes place in a specific environment called “at risk”.

Each participant is aware, given the specific nature of the activities practiced, that he may run some risks due in particular to the remoteness, isolation and specific nature of the activity and environment (river, cave, etc.). ). He assumes them with full knowledge of the facts and he must comply with the rules of prudence and follow the recommendations of the federations, associations and competent authorities.

The participant / client is responsible for the equipment that has assigned him / her. VALRAFTING can not be held responsible for damages that may be caused by this material. In the event of theft, loss or damage to the rented equipment, the participant / customer will be asked for compensation for wear and tear or a total refund of the equipment.

VALRAFTING can not be held responsible for the loss, theft (including in vehicles) or the breakage of objects (eg glasses, cameras …) that the practitioners could take with them during the activity and can provide course of the activity.

ART. 6 – CANCELLATION / INTERRUPTION BY CUSTOMER

6.1 Cancellation by the client

6.2 Cancellation by VALRAFTING

VALRAFTING reserves the right to cancel an activity for safety reasons (weather, maintenance of the course, floods …) or for any other case of force majeure. In this case and to the extent possible, another date / slot will be offered to the client. If the exit can not be carried out, the sum paid will be fully refunded without being able to claim any other compensation.

6.3 Exclusion / refusal of equipment rental

VALRAFTING reserves the right to refuse the hiring of material to a participant whose level of competence does not allow to practice only the activity in safety or whose behavior is likely to compromise his own safety and that of the group which accompanies it. In this case, the customer or participant can not claim any refund or compensation.

ART. 7 – YOUNG (MINORS):

Unaccompanied Minors: Minors under 18 years old who are not accompanied by an adult (legal guardian) are not authorized to rent technical equipment.

ART. 8 – SETTLEMENT OF DISPUTES

The parties will endeavor to resolve amicably possible difficulties that may arise in the performance of the contract. If no amicable agreement could be reached, all disputes relating to the validity, interpretation and execution of this agreement will be governed exclusively by the rules of Swiss law.

All disputes, of whatever nature, will fall within the jurisdiction of the Swiss civil and commercial courts.
